“Finally, we have heard from BNSF and, unfortunately, they have
informed us that they are not willing to accept the redlined agreement we
submitted. However, BNSF has recently signed an agreement with another division
of the City for the use of their access road adjacent to their rail tracks.
While the use and requirements of this agreement will be different from the use
and requirements of the pedestrian fencing in Crescent Beach, there may be a
possibility of getting their approval for a similar agreement. So we have asked
our lawyers to look into this.
Also, as I mentioned
before, due to the uncertainty in getting BNSF’s approval for constructing the
pedestrian safety fencing within their right-of-way, we are exploring the
possibility of building it in the City right-of-way. As part of this exercise,
we are evaluating impacts related to underground utilities, on-street parking,
traffic flows, emergency services, etc. This will also require neighbourhood engagement
and confirmation from BNSF that the new alignment (if feasible) will be
acceptable to them.”
